The Federal Trade Commission (FTC) requires clear disclosure when influencers receive compensation for posts. This guide explains the requirements for brands and creators using InfluenceForge AI.
1. Why Disclosure Matters
The FTC protects consumers from deceptive advertising. When creators receive free products in exchange for content, this is a "material connection" that must be disclosed. Non-compliance can result in fines up to $50,120 per violation.
2. Required Disclosures
For Creators
Every sponsored post must include clear disclosure:
- #Ad or #Sponsored in the post caption
- Disclosure must be "clear and conspicuous" - not buried in hashtags
- Disclosure must appear at the beginning of captions
- Platform paid partnership labels (Instagram, TikTok) are also acceptable
For Brands
As a brand using our platform, you must:
- Ensure creators understand disclosure requirements
- Include disclosure guidelines in campaign briefs
- Reject content that doesn't include proper disclosure
- Keep records of disclosure compliance
3. Platform-Specific Requirements
Use "Paid partnership with [brand]" label OR #Ad in first line of caption. Hashtags don't count if buried.
TikTok
Use "Paid partnership" label or #ad in video or caption. Verbal disclosure in video also accepted.
YouTube
Disclosure in video description AND verbal in video. Use "Includes paid promotion" or similar.
4. What Counts as Compensation
The FTC considers these as compensation requiring disclosure:
- Free products (even if no obligation to post)
- Cash payments
- Discounted products or services
- Affiliate commissions
- Gift cards or credits
- Exclusive access to products
5. Best Practices
- Make disclosure unavoidable - don't rely on platform labels alone
- Use #Ad or #Sponsored, not vague terms like #PR, #Gifted, or #Collab
- Place disclosure where it won't be missed - first 1-2 lines of caption
- When in doubt, disclose - better to over-disclose than under-disclose
- Educate creators on your team about requirements
